These “Terms and Conditions” govern your use of imacorp.com (the “IMA web site”) and also provide notice of privacy policies that apply to the IMA web site. The IMA web site is owned and operated by The IMA Financial Group, Inc. (“IMA”) as a service to clients of IMA of Colorado, Inc., IMA of Kansas, Inc., and IMA of Texas, Inc., subsidiaries of IMA, and clients of IMA’s other subsidiaries. IMA and all of its subsidiaries are sometimes referred to below as the “IMA Group”. “You” refers to individuals and entities accessing the IMA web site for any reason.

Please read these Terms and Conditions carefully. By using the IMA web site, you accept and agree to be bound by these Terms and Conditions. If you do not wish to accept these Terms and Conditions, please do not use the IMA web site. These privacy policies apply to IMA’s collection and use of any personal information you provide to IMA through the IMA web site. If you are an individual who has purchased an insurance product through the IMA Group for personal, family, or household purposes, please click on the following link to review the IMA Privacy Policy Notice (Effective July 1, 2001), notifying you of additional privacy policies that apply to you.

IMA collects all of the personal information that you elect to provide IMA in the course of your use of the IMA web site, including your name, mailing address, phone number, and e-mail address. IMA may share your personal information within the IMA Group, for purposes of serving your insurance needs and to provide you with information about products and services of the IMA Group. Unless disclosure is required by law or legal process, IMA does not disclose your personal information to individuals or entities that are not part of the IMA Group, except as is required to obtain insurance coverage requested by you, process your insurance claims, and service your account.

Security
The IMA web site is hosted by ViaWest Internet Services, Inc. (“ViaWest”). IMA’s contract with ViaWest provides that ViaWest shall not disclose or use any data or information, and shall use commercially reasonable efforts to provide protection for all data and information, that is stored on the dedicated server used by ViaWest to host the IMA web site.

Transaction of Insurance Business Using the IMA Web Site
If you are already a client of IMA, you may be able to access information about your insurance coverage and transact business with IMA concerning your insurance coverage through the IMA web site. Please contact your account manager for further information.

Site Content
The IMA web site and all of its content including, but not limited to, articles, other text, photographs, illustrations, graphics, product names, designs, logos, trademarks, video material and audio clips (the “Intellectual Property”) are protected by copyright, trademark, and other laws of the United States, as well as international conventions and the laws of other countries. The Intellectual Property is owned or controlled by IMA, a member of the IMA Group, or the party credited as the provider or owner of the Intellectual Property. The compilation (meaning the collection, arrangement and assembly) of all content on the IMA web site is the exclusive property of IMA and protected by United States and international copyright laws. All software used on the IMA web site is the property of commercial software suppliers or IMA, and is protected by United States and international copyright laws.

You may view, copy, download or print material appearing on the IMA web site subject to the following conditions:

1. The material may only be used for your personal, non-commercial use;
2. The material may not be modified;
3. All copyright, trademark, and other proprietary notices contained in all such copies must be kept intact; and
